1. Acceptance of Terms

By creating an account or using Crumblelead, you agree to these Terms of Service, including the Data Processing Addendum below. If you are agreeing on behalf of an organisation, you represent that you have authority to bind that organisation.

2. Description of Service

Crumblelead is a cloud-based applicant tracking and recruitment management platform designed for staffing agencies and in-house recruitment teams. The platform provides candidate management, job pipeline tracking, client relationship management, reporting, and AI-powered recruitment tools. Crumblelead is operated by Tonight Media Co., Ltd, a company registered in Thailand (Tax ID 0205562013361).

3. Account Registration & Security

Users are responsible for maintaining the security of their login credentials. Each person should have their own account. The team administrator manages team membership and roles. You must notify us immediately of any unauthorised access.

4. Acceptable Use

You agree not to:

  • Use Crumblelead to collect candidate data without a lawful basis
  • Share login credentials with unauthorised individuals
  • Upload malicious content
  • Attempt to access other teams' data
  • Use the platform to discriminate unlawfully against candidates
  • Circumvent usage limits or security measures

5. Subscription & Billing

Crumblelead uses Stripe for payment processing. Plans are billed per seat on a recurring basis. A free trial period is included with new accounts. Subscriptions auto-renew unless cancelled before the renewal date. The team owner is the responsible billing party. We may adjust pricing with 30 days written notice.

6. Data & Privacy

Your use of Crumblelead is also governed by our Privacy Policy. As a customer, you are the data controller for any candidate and client data you upload to the platform. Crumblelead acts as a data processor on your behalf. The Data Processing Addendum in Section 14 below sets out the terms of that processing relationship.

7. AI-Powered Features

Crumblelead uses third-party artificial intelligence services for resume parsing, candidate matching, and candidate ranking. When these features are used, candidate personal data including resume content, skills, experience, and profile information is sent to our third-party AI provider for processing. AI outputs are assistive tools to support recruiter decision-making and should not be the sole basis for hiring decisions. Customers are responsible for informing their candidates that AI processing may be used as part of their recruitment activities.

8. Intellectual Property

Crumblelead and its licensors own all rights in the platform, including its code, design, and documentation. You retain full ownership of all data you upload to the platform. We claim no intellectual property rights over your candidate data, client data, notes, files, or any other content you create within the platform.

9. Termination

Either party may terminate the agreement at any time. Upon termination, your data remains available for export for 30 days using the platform's built-in export tools. After 30 days, all data is permanently deleted from our systems, including backups, within a reasonable timeframe.

10. Limitation of Liability

Crumblelead is provided on an "as is" basis. While we strive for high availability and data integrity, we do not guarantee uninterrupted service. Crumblelead is not liable for hiring decisions made using the platform, loss of revenue arising from service interruptions, or actions taken based on AI-generated recommendations. Our total aggregate liability is limited to the fees paid by you in the 12 months preceding the claim.

11. Governing Law

These Terms are governed by the laws of the Kingdom of Thailand. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Thailand.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email at least 30 days before they take effect. Continued use of the platform after the notice period constitutes acceptance of the updated Terms.

14. Data Processing Addendum

This Data Processing Addendum forms part of these Terms of Service and applies to the processing of personal data by Crumblelead on behalf of the Customer.

14.1 Definitions

"Controller" refers to the Customer (the recruitment agency or employer using Crumblelead). "Processor" refers to Crumblelead, operated by Tonight Media Co., Ltd. "Data Subjects" refers to candidates, client contacts, and any other individuals whose personal data is uploaded to the platform. "Personal Data" has the meaning given in the General Data Protection Regulation (EU) 2016/679 and the Personal Data Protection Act B.E. 2562 (2019) of Thailand.

14.2 Scope & Purpose

Crumblelead processes personal data solely to provide the recruitment management service as instructed by the Controller. Categories of personal data processed include: candidate profiles, resumes, contact details, employment history, education records, skills assessments, salary information, recruiter notes, email communications, and uploaded files.

14.3 Processor Obligations

Crumblelead shall:

  • Process personal data only on the Controller's documented instructions
  • Ensure that all personnel with access to personal data are bound by confidentiality obligations
  • Implement appropriate technical and organisational security measures including encryption at rest and in transit, role-based access control, and audit logging
  • Assist the Controller in responding to data subject requests including access, erasure, and rectification
  • Delete or return all personal data upon termination of the agreement
  • Make available information necessary to demonstrate compliance with these obligations

14.4 Sub-processors

Crumblelead uses sub-processors to deliver parts of the service. A current list is maintained at our Sub-processors page. The Controller consents to the sub-processors listed as of the date of acceptance. Crumblelead will notify the Controller via email at least 30 days before engaging any new sub-processor, and the Controller may object by contacting [email protected].

14.5 International Transfers

Where personal data is transferred outside the Controller's jurisdiction, Crumblelead relies on Standard Contractual Clauses or other appropriate safeguards as required by applicable data protection law.

14.6 Security & Breach Notification

Crumblelead implements encryption, access controls, and comprehensive audit logging. In the event of a personal data breach, Crumblelead will notify the Controller without undue delay and in any event within 72 hours of becoming aware of the breach, providing details of the nature of the breach, the categories and approximate number of data subjects affected, and the measures taken to address the breach.

14.7 Data Retention & Deletion

Personal data is retained for the duration of the service agreement. Controllers can configure candidate retention periods through the platform's settings. Upon termination, data is available for export for 30 days and is permanently deleted thereafter.

14.8 Audits

The Controller may audit Crumblelead's compliance with this addendum upon reasonable notice. Crumblelead will cooperate with such audits and provide the necessary information and access.
